Fatal brain injury results from landlord/tenant dispute

Any injury to the brain is a serious matter. A brain injury can result in impaired function that may continue for the rest of the person's life. In some cases, it can even lead to death. The recent death of a New York City landlord who was hurt during a disagreement with his tenant shows just how serious brain injuries can be. 

Officials say that a landlord went to visit a home he owned with the aim of collecting rent from the person who lived there. Police say that surveillance video shows the landlord attempting to enter the home and getting into a physical altercation with someone inside. They also claim that the tenant pushed the landlord down the stairs, causing him to strike his head on the concrete sidewalk. Authorities say that this resulted in a traumatic brain injury and his eventual death. 

Police claim that the tenant did not try to help the man and that a neighbor finally found the landlord on the ground, not moving. Authorities also say that the video shows another person who left the scene with the tenant, but briefly stopped to check on the landlord's condition. The tenant has since been arrested and faces multiple charges, including first and second-degree manslaughter.

Even if the tenant had no intention of killing the landlord, he could be facing not only criminal charges but a civil claim as well. The family of the landlord may decide to pursue a wrongful death claim because of the traumatic brain injury that led to the man's death. A claim that is successfully litigated by an attorney here in New York may result in a judgment for monetary damages incurred as a result of the tragic incident.
